Is it really derivative work if you see something in a utilitarian marketing symbol and "re-purpose" it for its aesthetic qualities by re-framing it contextually for the viewer in a way that points out its cultural relevance with some degree of irony, not to mention skill and technique in the execution?
That is to say, by your standard, wouldn't nearly all art be "derivative" art?
